It's a tough time for the family from TLC's hit series, "Here Comes Honey Boo Boo." Over the past few days, they've weathered a mysterious health emergency and the loss of a beloved pet.

The woes started last Friday evening, when dad Mike "Sugar Bear" Thompson collapsed and was taken to the hospital. According to posts on the official Honey Boo Boo Facebook fan page, which is run by "Mama" June Shannon and a family friend, Sugar Bear underwent "a lot of tests on his brain" and the family feared it could be "very serious." Recent posts on both their Facebook and Twitter accounts added the hashtag "#prayforsugarbear."

But in the midst of the crisis, things got even worse for the reality TV stars from McIntyre, Ga.

While Thompson remained at the hospital, they discovered that the family dog, a Chihuahua named China they'd rescued six years earlier, had been "hit and left to die."

"(She was) still spasming as they found her," one Facebook post explained. "We think it may have been done intentionally cause of where she was found."

As for Thompson, the latest updates indicate there's been no change in his condition. The cause of his collapse is still a mystery.

The incident is just the latest in a long list of medical emergencies for the family patriarch in recent months. Last September, he was hospitalized due to a foot infection following a "mud-boggin'" accident. Then, in December, an ambulance was called after he fell ill during a toy drive. And just three months ago, he was hospitalized again after a bout of pancreatitis.

TODAY.com reached out to TLC about the family's troubles. The network had no comment.

Ancient plants reawaken: Plants exposed by retreating glaciers regrowing after centuries entombed under ice

May 28, 2013 ? When University of Alberta researcher Catherine La Farge threads her way through the recently exposed terrain left behind by retreating glaciers, she looks at the ancient plant remains a lot closer than most. Now, her careful scrutiny has revealed a startling reawakening of long-dormant plants known as bryophytes.

La Farge, a researcher in the Faculty of Science, and director and curator of the Cryptogamic Herbarium at the University of Alberta, has overturned a long-held assumption that all of the plant remains exposed by retreating polar glaciers are dead. Previously, any new growth of plants close to the glacier margin was considered the result of rapid colonization by modern plants surrounding the glacier.

Using radiocarbon dating, La Farge and her co-authors confirmed that the plants, which ranged from 400 to 600 years old, were entombed during the Little Ice Age that happened between 1550 and 1850. In the field, La Farge noticed that the subglacial populations were not only intact, but also in pristine condition -- with some suggesting regrowth.

In the lab, La Farge and her master's student Krista Williams selected 24 subglacial samples for culture experiments. Seven of these samples produced 11 cultures that successfully regenerated four species from the original parent material.

La Farge says the regrowth of these Little Ice Age bryophytes (such as mosses and liverworts) expands our understanding of glacier ecosystems as biological reservoirs that are becoming increasingly important with global ice retreat. "We know that bryophytes can remain dormant for many years (for example, in deserts) and then are reactivated, but nobody expected them to rejuvenate after nearly 400 years beneath a glacier.

"These simple, efficient plants, which have been around for more than 400 million years, have evolved a unique biology for optimal resilience," she adds. "Any bryophyte cell can reprogram itself to initiate the development of an entire new plant. This is equivalent to stem cells in faunal systems."

La Farge says the finding amplifies the critical role of bryophytes in polar environments and has implications for all permafrost regions of the globe.

"Bryophytes are extremophiles that can thrive where other plants don't, hence they play a vital role in the establishment, colonization and maintenance of polar ecosystems. This discovery emphasizes the importance of research that helps us understand the natural world, given how little we still know about polar ecosystems -- with applied spinoffs for understanding reclamation that we may never have anticipated."

The research was published in the Proceedings of the National Academy of Sciences.

Where Can Police Search Near my Home? - Chicago Criminal ...

According to the Fourth Amendment, our home is afforded the most protection from unwarranted intrusion by law enforcement. ?Even though the law recognizes the sanctity and privacy of the home above all other places, there are locations around the home that may not be given the same protection.

Open Fields Doctrine

The Open Fields Doctrine stands for the notion that private property may still be entered by law enforcement without implicating the Fourth Amendment. ?Defined by the U.S. Supreme Court, an ?open field? as any unoccupied or undeveloped area outside the home. ?Even if signs are posted warning trespassers, law enforcement is not in violation of constitutional rights by ignoring them in the course of an investigation.

This is in stark contrast to an unwarranted search of a home, where the Fourth Amendment is implicated and any evidence so obtained would be considered inadmissible. ?The reasoning behind the different legal treatment of a home and open land is that there is no legitimate privacy interest for activities conducted out of doors for any onlooker to see.

Curtilage

Curtilage is a legal term used to denote the area immediately surrounding the home. ?The curtilage is offered a heightened level of privacy as an extension of the home itself. ?Determining the curtilage is done on a case-by-case basis because homes and private activities conducted therein can differ. ?The factors a court will look at in determining if an area is curtilage is:

1. The proximity of the area claimed as curtilage to the home

2. Whether that area is included inside of an enclosure surrounding the home

3. The nature of the use that area is put to, and

4. Any steps the resident has taken to protect that area from public view. ?See U.S. v. Dunn.

Although curtilage is provided Fourth Amendment protection, surveillance of curtilage does not always trigger the Fourth Amendment. ?For example, in California v. Ciraolo, a man challenged police surveillance of a marijuana grow operation in his backyard. ?The man had a high fence surrounding his yard that effectively prevented public view. ?He argued that his yard was thus curtilage because it was private and shielded from view and the police violated his constitutional rights by taking an unwarranted look.

The court didn?t agree and found that the surveillance didn?t violate the Fourth Amendment. The court came to this conclusion by reasoning the man did this illegal activity in the open and anyone from a high vantage point could see. ?Since he did that, the man had no reasonable expectation of privacy in activities that could be seen by the naked eye from somewhere.

In cases where a search takes place beyond the curtilage, but not an open field either, the U.S. Supreme Court has determined that the Fourth Amendment is not implicated here. ?For example, trash left out on the curb to be picked up is not entitled to heightened Fourth Amendment protection against police sifting through it and collecting evidence before it is picked up. ?The reasoning behind this is that a person effectively negates any expectation in those items remaining private once they are put out for disposal.

The law carefully balances rights of citizens against permissible police conduct. ?Criminal law is complex and ever changing. ?Contact a qualified Illinois Criminal Defense Attorney for more information and sound legal advice.

Cisco challenges Microsoft buy of Skype in EU court

BRUSSELS (Reuters) - Cisco Systems Inc, the world's leading network equipment maker, will try to convince Europe's second highest court on Wednesday that it should overturn the EU's approval of Microsoft's purchase of Skype.

If Cisco wins the challenge at the Luxembourg-based general court, the European Commission would have to annul its decision, which allowed Microsoft to buy the Internet video and voice company without having to make any concessions.

Cisco, which is appealing together with Italian fixed-line and Internet telephone provider Messagenet SpA, will argue that the Commission made several "manifest errors" in assessing the $8.5 billion Microsoft-Skype deal.

It is expected to argue that the combined company's dominant share in the communications market gave it the ability and the incentive to refuse to provide data that would allow rivals to work with the merged firm's products.

The last time a company successfully challenged a Commission merger-approval decision at the court was in 2002 in a case involving the Sony Music and BMG record labels. In the vast majority of cases, the court rules with the Commission.

A decision by the EU's general court can be appealed to the European Court of Justice, the EU's highest court.

Cisco's challenge is one of four court cases against the European Commission's rulings in merger cases.

Deutsche Boerse last year filed an appeal against the Commission's rejection of its merger with NYSE Euronext while UPS has take action against a regulatory veto of its proposed TNT buy.

Ryanair has similarly said it will fight the Commission's veto of its plan to buy Aer Lingus.

Two Pink Peas: My Craft Room Sensory Overload.....& Craft Room ...

Boy talk about sensory overload today...After unpacking more boxes of craft supplies my head was literally spinning.

But what a great problem to have and I am definitely NOT complaining. I know and realize how very blessed I am to be able to buy so many amazing craft supplies. I wanted to apologize for this video...I took it on my cell phone and I was turning it up and sideways so some of the video is sideways because of that. But I wanted to show you all what it looks like in a video versus plain old photographs. I hope you all don't get dizzy watching this video..lol. Oopsie! :)

I have been slowly but surely been unpacking my massive amounts of craft supplies in my new craft room. Four days a week I babysit my beautiful little granddaughter and so I have not had much time to really get in my room and unpack/organize my stuff. I will have to post some photos of her soon...she is absolutely beautiful and she has the funniest most beautiful little personality already. We love her so very much and I am so blessed that I get to spend so much time with her. We have such a special bond already and she just melts my heart every time she looks at me with her gorgeous gigantic smile. Ahh.. I could talk about her for hours and hours. Such a sweet little girl. We are so blessed to have Kenzie in our family.

Ok... so back to my craft room...lol. Once I get talking about Kenzie I can ramble on and on about how amazing she is...so let me stop now before I forget what I wanted to post for you all tonight. Before we sold our last house and moved I did not feel comfortable leaving all of my cricut cartridges in storage. As you all know these cartridges and craft supplies in general are really expensive and so to be safe I emptied every cartridge taking out each booklet, overlay and cartridge. I put all of my cartridges in big gallon baggies and kept them at my in laws (they were a God send allowing us to store so many of my craft supplies in their home for close to 9 months and I appreciate them being so kind. I don't know what I would have done without them..so a huge Thank You to my in laws for being so sweet about it) because keeping them stored in a storage unit exposed to all the extreme elements really worried me. There was no way I wanted to take a chance and have any of them ruined. My cricut booklets and cartridge boxes were stored in our storage unit while the overlays and cartridges themselves were kept inside the house. As you see I have alot of cartridges and today I wanted to get the cartridges, overlays and booklets back in their proper cases. Thank goodness for my sweet little girl Hallie and my niece Jillian as they really helped me ALOT. Having their help really shaved alot of time and for that I am so grateful. So here is a few photos of what our mess looked like before.

All of my cartridges after being taken out of the gallon baggies...and if you have not watched my video above you will see just how many Cricut Cartridges I have.

The overlays I stored in a big boot shoe box and these were kept inside. We have extreme weather here and I was not going to take any chances of them being ruined.

After finishing putting my cartridges back together I wanted to tackle my stamps. This is not all that I own.. this was just the ones I had packed in a big box. It has been about 9 or 10 months since I have seen all of my supplies and so it kinda felt like Christmas to me today.

This is the other half of what was in the box. When you go as long as I did not being able to see and use all your craft supplies you literally forget what you have. At least that is how it was for me. But I will admit that my memory is horrible..lol. That is why I said it was sensory overload for me today..lol. For months now I have been brain storming trying to figure out how I was going to organize all my stamps so that I could easily find what I need in a speedy manner. It bugs me so much when I need a stamp or punch and I cannot find it and then I spend a ton of time just searching for it. Spending so much time searching for certain craft supplies takes away from being able to create and plus I don't like it when I cannot find what I need quickly.

After thinking and thinking about how in the world I could organize these wood mounted stamps so that I could easily find what I need and grab it and go I thought why not store my stamps like they do in some craft stores??!! So that is exactly what I am gonna do. This is a photo I found on Pinterest (picture is below...I pinned it under Two Pink Peas Craft Room Ideas this link takes you to my Pinterest page which is amazing as I am always pinning so many creative and amazing cards and crafts so please feel free to follow me) that shows you what I am talking about. Except I am gonna have longer slats of wood and probably more rows since I have so many wood mounted stamps...plus I plan to continue to purchase more and more as I am addicted to them! As far as my acrylic stamps...and I have ALOT...I am not 100% sure yet on how I am going to organize them. One of my blog readers suggested storing them in empty clear cd cases and I might just do that.

For those who have a ton of stamps how do you store yours and what is the best way you have organized them so that they are easy to find when you need them? Any suggestions or comments are always greatly appreciated!

Storing wooden stamps this way is probably my favorite storage idea that I have found so far. Finding an image is so easy when they are displayed this way. For those who do not know I am having a giveaway for the one who gives me the most creative or smart idea on how to store craft supplies. With much of its information obscured it's hard to say what Google has planned for this new device revealed by its FCC filing, but the model number at least indicates someone has a sense of humor. Called an "H840 device" and rocking the model number H2G2-42 (Hitchhiker's Guide to the Galaxy - 42, the ultimate answer to the question of life, the universe and everything) it has WiFi of the 802.11 b/g/n varieties, but that's all we know for sure. The natural question is whether this is a proper revamp of / follow up to the failed Nexus Q project, particularly with its appearance coming so closely after the unveiling of its Google Play Music All Access subscription. Of course, Google has no shortage of mysterious device projects in store, we're hopeful this one will reveal all of its secrets soon.

Iran's Farhadi and China's Jia make Cannes splash

CANNES, France (AP) ? Two directors from countries with tough film censorship brought bold and probing movies to the Cannes Film Festival on Friday ? one exploring China's social problems, the other delving into the mysteries of the human heart.

Jia Zhangke's "A Touch of Sin" depicts facets of fast-changing China that the government prefers to avoid: corruption, greed, violent crime and the growing gap between economic winners and losers.

"The Past," by Academy Award-winning Iranian director Asghar Farhadi, is an unsparing tale of domestic upheaval, set in and around Paris and made with a largely French cast.

Both films are competing for Cannes' top prize, the Palme d'Or ? and both have been cleared for release in their homelands, where filmmakers often fall foul of restrictions.

Iran's Ministry of Culture and Islamic Guidance has approved "The Past" for screening, and "A Touch of Sin" is due to open in China in the fall.

The two directors are pleased their films will be seen at home, but they gave very different descriptions of working in settings where official censorship is an everyday reality.

"I'm someone who is deeply attached to my creative freedom, and I always do my utmost to ensure I don't indulge in any form of self-censorship," said Jia, who has explored China's rapid transformation throughout his career ? from early underground films such as "Unknown Pleasures" to documentaries to the Venice Film Festival prize-winning 2006 feature "Still Life."

Farhadi, though, said the effect of censorship was more insidious.

"One can try to free oneself of the past, but the past doesn't let you do that," he said ? both a theme of "The Past" and an observation of his own situation.

"There are two kinds of censorship," he told reporters. "You have official censorship which works in a certain way. But there is also self-censorship. You impose it on your innermost self."

Iran's authorities have long had an uneasy relationship with the country's filmmakers, and influential clerics have often denounced the domestic cinema as dominated by Western-tainted liberals and political dissenters. Some directors and actors have faced arrest or fled the country.

While Farhadi shot previous films including "A Separation" ? the 2012 foreign-language Oscar winner ? in Iran, "The Past" was made entirely outside the country. It follows an Iranian man (actor-director Ali Mosaffa), who returns to France to finalize a divorce from his ex (Berenice Bejo, from "The Artist"), but soon becomes entangled again with her, her children and her new love ("A Prophet" star Tahar Rahim).

The film premiered at Cannes Friday and was hailed as the first Palme d'Or contender of the festival. Critics praised its meticulous and non-judgmental look at the messy effects of relationships and their breakdown, on adults and on children.

Farhadi admitted that he felt "more secure" shooting outside Iran, free of external restrictions ? but not of his own inner guidelines. He said he tried to see these "not as an obstacle but as an asset" ? part of his creative makeup as a director.

Like his previous work, "The Past" is emotionally revealing but not overtly political. The director said he was happy to keep working on an intimate canvas, exploring the dynamics of personal relationships.

"There is so much suffering and pain attached to a couple, but the suffering and pain is always unique," he said. "I could spend my whole career exploring this theme without ever exhausting it."

Farhadi said he doesn't know what he will make next ? or whether it will be in Iran.

"I won't decide where it will take place," he said. "It's history that will decide for me."

In contrast, "A Touch of Sin" feels strongly political. Made up of four linked episodes focusing on uprooted citizens of the new China, its storylines have been ripped from the headlines. There's a villager driven to violence by official corruption; an amoral killer roaming the land; a factory worker driven to suicide.

Jia ? whose film "24 City" played at Cannes in 2008 ? said he became preoccupied by the increasingly frequent stories of violence he saw in the media, and wanted to dramatize the stories for Chinese moviegoers.

"In society people often hear about these violent events, but they quickly forget," he said. "It's not by turning your back on violence or hiding violence that you make progress."

Jia said he didn't think the topics he depicted "are particularly touchy or secretive in any way, because they were already covered in the Chinese press and on the Internet."

But the director also was careful to stress ? and the censors no doubt happy to hear ? that the stories were timeless, not the product of modern politics, economics or technology.

"If these people were alive 100, 200, 300 years ago, at the time of the emperors, their motivation for acting like that would be exactly the same," he said. "We live in the era of the Internet and high-speed trains, but have people changed?"

When JJ Abrams said that he wanted to put some Star Wars into Star Trek, apparently it also applied to the scale of spaceships. And while the new Enterprise doesn't even reach half of the 1,600 meters?that's a mile long?of an Imperial Star Destroyer, it's still amazingly big compared to the 288 meters of the old Enterprise. Maybe now you would be able to take down an Star Destroyer with a couple of these.

(AP) ? An ethno-inspired flute and drum tune from Denmark is the bookmakers' favorite to win this year's Eurovision Song Contest, which also features a bizarre opera pop number from Romania and an Armenian rock song written by the guitarist of Black Sabbath.

Yes, it's that time of the year again.

The televised pan-European extravaganza, known for its kitschy shows, bad taste and bizarre offerings, is still expected to be seen by about 125 million television viewers worldwide Saturday.

This year's contest is being hosted in Malmo, southern Sweden, following the victory of the Nordic country's contestant Loreen last year.

According to bookmakers, the hippie-chic Emmelie De Forest of Denmark is the favorite to win, driving the song "Only Teardrops" with her deep, Shakira-like voice. Her main challenge comes from the clean-cut techno pop tune "I Feed You My Love" by Norway's Margaret Berger, who rose to fame at home after becoming the runner-up in Norway's version of Pop Idol in 2004.

"I will be nervous before going on stage," De Forest said Friday. "I think we have a really good song that can take us far, but let's see, anything can happen."

Finland's Krista Siegfrid provided this year's controversy, ending her bouncy bubble-gum pop number "Marry Me" with a girl-on-girl kiss that some have interpreted as a stance promoting gay marriage. While the show will not raise eyebrows in most parts of Western Europe ? where Eurovision has long been a bastion of gay culture ? the act may jar sensitivies in parts of eastern and southern Europe.

"The fact is that Finland is the only country in the Nordic countries where gay marriage is not allowed, and I think that's wrong," Siegfrid told The Associated Press. "It's 2013 now and ... I can kiss anyone I want to. It shouldn't be a problem."

This year's competition also sees the return to the international stage of two seasoned European stars. "Total Eclipse of the Heart" singer Bonnie Tyler is representing Britain with "Believe In Me" while Anouk, whose song "Nobody's Wife" was a big hit in Europe in the 1990s, is singing the song "Birds" for The Netherlands.

Among the more notable performances is the Ukraine's Zlata Ognevich with her song "Gravity." Ognevich is carried onto the stage by the tallest man in the U.S. ? Ukrainian-born Igor Vovkovinskiy. Vovkovinskiy ? who stands 7 feet 8 inches (234 cms) ?wobbles onstage in a fur and feathers, placing the fairy-like Ognevich on a rock where she stands for the rest of the performance.

There is also Armenian rock group Dorians, whose gloomy song "Lonely Planet" has been written by Black Sabbath guitarist Tony Iommi and Romania's Cezar, who resembles a Dracula reborn as a castrato singer. Cezar is apparently a reputable opera singer, but is attempting a crossover opera pop number with techno beats and pyrotechnics. Three muscular male dancers in red body paint are delivered out of a large red cape.

Two semifinals this week have whittled down the contestants from 40 to 26. The winner is picked by juries and television viewers across the continent.

House chairman sees IRS errors as part of pattern

WASHINGTON (AP) -- The Internal Revenue Service's improper use of tougher scrutiny of conservative groups seeking tax-exempt status seems part of a broader pattern of intimidation and cover-ups by the Obama administration, a top House Republican said Friday.

The accusation by House Ways and Means Committee Chairman Dave Camp, R-Mich., came as his panel held the first congressional hearing into the tax agency's improper targeting of tea party and other conservative groups. At a session that saw the IRS face harsh criticism from members of both parties, the just-ousted acting chief of the agency, Steven Miller, expressed regret for the heightened reviews.

"I want to apologize on behalf of the Internal Revenue Service for the mistakes that we made and the poor service we provided," Miller told the committee. "The affected organizations and the American public deserve better. Partisanship and even the perception of partisanship have no place at the Internal Revenue Service."

Miller conceded that "foolish mistakes were made" by IRS officials trying to handle a flood of applications for tax-exempt status. He said the process that resulted in conservatives being targeted, "while intolerable, was a mistake and not an act of partisanship."

Though Miller and another top IRS official are stepping down, Camp said that would not be enough.

"The reality is this is not a personnel problem. This is a problem of the IRS being too large, too powerful, too intrusive and too abusive of honest, hardworking taxpayers," Camp said.

Friday's hearing is the first of what are expected to be many on the subject by congressional panels. Underscoring the seriousness of the episode, Miller was sworn in as a witness, an unusual step for the Ways and Means panel and one that could put Miller in jeopardy if he is later shown to have misled lawmakers with his testimony.

Camp referred to a "culture of cover-ups and intimidation in this administration," but offered no other examples.

The administration has been forced on the defensive about last September's terrorist attack in Benghazi, Libya, that killed the U.S. ambassador and three other Americans, and the government's seizure of The Associated Press' telephone records as part of a leaks investigation.

Republicans are hoping to link the issues in an effort to raise questions about President Barack Obama's credibility and make it harder for him to press a second-term agenda.

Camp's remark about cover-ups drew a sharp retort from the committee's top Democrat, Rep. Sander Levin of Michigan. Levin said if the hearing became a preview of the 2014 political campaigns, "we'll be making a very, very serious mistake."

Even so, Levin also was harshly critical of the IRS's treatment of conservative groups, saying the agency "completely failed the American people." He said Lois Lerner, who heads the IRS division that makes decisions about tax-exempt groups, should be "relieved of her duties."

Miller said the IRS struggled to efficiently handle growing numbers of applications for tax-exempt status.

The agency has said between 2008 and 2012, the number of groups applying for tax-exempt status as so-called social welfare groups more than doubled. Along with that was an increase in complaints that such groups were largely engaging in electoral politics, which is not supposed to be their primary activity.

"I do not believe partisanship motivated the people" at the IRS who engaged in the harsher screening for conservative groups, Miller said.

In recent months, Republicans on the Ways and Means panel had repeatedly asked the IRS about complaints from conservative groups that their applications were being treated unfairly.

On Friday, numerous Republicans wanted to know why Miller and others never told them the groups were being targeted, even after May 2012, when the IRS has said Miller was briefed on the practice. Miller was previously a deputy commissioner whose portfolio included the unit that made decisions about tax-exempt status.

"I did not mislead Congress or the American people," Miller told Rep. Charles Boustany Jr., R-La., one of several Republicans who challenged him about why he hadn't mentioned the targeting in the past.

Also testifying Friday was J. Russell George, the Treasury Department's inspector general for tax administration.

In a report he issued this week, George said IRS officials reported they were not politically pressured to target conservative groups. Asked about that conclusion, George said Friday, "We have no evidence at this time to contradict that assertion," but in prepared testimony to the committee he said he is continuing to investigate that question.

George's report concluded that the IRS office in Cincinnati, which screened applications for the tax exemptions, improperly singled out tea party and other conservative groups for tougher treatment. The report says the practice began in March 2010 and lasted more than 18 months.

The report blamed "ineffective management" for letting IRS officials craft "inappropriate criteria" to review applications from tea party and other conservative groups, based on their names or political views. It found that the IRS took no action on many of the conservative groups' applications for tax-exempt status for long periods of time, hindering their fundraising for the 2010 and 2012 elections.

Republicans have spent the past few days trying to link the IRS' improper scrutiny of conservatives to Obama. The president has said he didn't know about the targeting until last Friday, when Lerner acknowledged at a legal conference that conservative groups had been singled out.

Many of the groups were applying for tax-exempt status as social welfare organizations, which are allowed to participate in campaign activity if that is not their primary activity. The IRS judges whether that imprecise standard is met.

Attorney General Eric Holder has said the FBI was investigating whether the IRS may have violated applicants' civil rights.

Obama has rejected the idea of naming a special prosecutor to investigate the episode, saying the investigations by Congress and the Justice Department were sufficient.

Obama has named Daniel Werfel, a top White House budget officer, to replace Miller.

Also Thursday, Joseph Grant, one of Miller's top deputies, announced plans to retire June 3, according to an internal IRS memo. Grant is commissioner of the agency's tax exempt and government entities division, which includes the agents that targeted tea party groups for additional scrutiny.

Grant joined the IRS in 2005 and took over as acting commissioner of the tax exempt and government entities division in December 2010. He was just named the permanent commissioner May 8.

When asked whether Grant was pressured to leave, IRS spokeswoman Michelle Eldridge said Grant had more than 31 years of federal service and it was his personal decision to leave.

Second court invalidates Obama recess appointment

(AP) ? A second federal appeals court has found that President Barack Obama exceeded his power when he bypassed the Senate to install a member to the National Labor Relations Board.

The ruling by the 3rd U.S. Circuit Court of Appeals in Philadelphia came on the same day that a Senate panel considered a slate of five nominees for full terms on the labor board. Senate Republicans said Thursday they would oppose two of the nominees ? Sharon Block and Richard Griffin ? because they currently sit on the board as recess appointments.

In its 2-1 decision ruling, the appeals court said that under the Constitution recess appointments can be made only between sessions of the Senate, not any time the Senate is away on a break.

The court's action mirrors a far-reaching ruling by the U.S. Court of Appeals in Washington, D.C., earlier this year. The Obama administration has appealed that ruling to the Supreme Court, arguing that such an interpretation would invalidate hundreds of recess appointments made by presidents over more than 100 years.

The latest ruling says Obama had no constitutional authority to install attorney Craig Becker to the labor board in 2010 while the Senate was adjourned for two weeks.

The White House did not immediately respond to a request for comment.

Both rulings have threatened to throw the labor board, the Consumer Financial Protection Board and other federal agencies with recess appointees into chaos. If they stand, hundreds of decisions by these agencies could be thrown out.

The narrow interpretation of a president's recess appointment power would also effectively make it impossible for the president to ever use that power, giving the Senate's ability to block administration nominees indefinitely.

Obama has made 32 recess appointments during his presidency, nearly all of which would be considered invalid under the interpretation of these courts. The rulings could also threaten the recess appointments of previous presidents. President George W. Bush made 141 such appointments in eight years.

On Capitol Hill, Tennessee Sen. Lamar Alexander, senior Republican on the Senate Health, Education, Labor and Pensions Committee, said he would not consider Block and Griffin because they refused to step down from the board after the District of Columbia Circuit ruled that they were unconstitutionally appointed. Block and Griffin said they wanted to abide by their oath to serve their country and argued that appeals courts have reached different conclusions about recess powers.

Democrats on the panel accused Republicans of obstructionism because the GOP and its allies in the business community have been unhappy with some of the union-friendly decisions issued by the board during Obama's administration. Unions warn that unless the nominees are confirmed soon, the board will be unable to function. It only has three members now, and the term of board chairman Mark Pearce expires in August.

In the 3rd Circuit case, the two-judge majority rejected the Obama administration's arguments that a Senate recess occurs any time lawmakers do not have a duty to attend, the Senate chamber is empty and the Senate cannot receive messages from the president.

"Defining recess in this way would eviscerate the divided-powers framework" of the Constitution, Judge D. Brooks Smith wrote in a 102-page decision. "If the Senate refused to confirm a president's nominees, then the president could circumvent the Senate's constitutional role simply by waiting until senators go home for the evening."

Smith, who was appointed by President George W. Bush, was joined in his opinion by Judge Franklin Stuart Van Antwerpen, an appointee of President Ronald Reagan.

A lengthy dissent came from Judge Joseph Greenaway Jr., who was appointed by Obama and joined the court in 2010. Greenaway said that under the majority's decision, the recess appointment power "is essentially neutered and the president's ability to make recess appointments would be eviscerated."

The case was brought by New Vista, a New Jersey nursing and rehabilitative care center that argued its nurses were supervisors who were not allowed to form a union. The labor board ruled in favor of the union and New Vista appealed. The company argued that the board did not have enough validly appointed members to reach a decision because Becker was not a valid appointee.

The labor board has five seats and needs at least three sitting members to conduct business. At the time of the New Vista ruling, it had the minimum of three, but one member was Becker, the recess appointee.

Becker is no longer on the NLRB, but the current board also has only three members, two of whom are Obama recess appointees. More than a hundred companies have appealed NLRB decisions this year arguing that the board does not have enough validly appointed members to conduct business.

Will Smith sets sights on 'Wild Bunch' reboot at Warner Bros.

LOS ANGELES (TheWrap.com) - Will Smith is in talks to star in and produce Warner Bros.' reboot of Sam Peckinpah's classic 1969 Western "The Wild Bunch," individuals familiar with the project have told TheWrap.

Smith would produce through his Overbrook Entertainment banner along with Jerry Weintraub, who recently worked with Smith on "The Karate Kid" remake.

The original "Wild Bunch" followed a group of aging outlaws that plan one last score on the Texas-Mexico border as the traditional American West changes around them in 1913.

A modern remake involving cartels south of the border, the "Wild Bunch" reboot is expected to follow a disgraced D.E.A. agent who assembles a team to go after a Mexican drug lord and his fortune.

Warner Bros. and Weintraub have been looking to reboot the property for years. David Ayer was hired to write a script and most recently, Tony Scott was developing the project with Oscar winner Brian Helgeland ("L.A. Confidential"), who wrote about half of the screenplay before Scott died last year.

The studio and producing team are currently looking to hire a new writer for the project, which provides the opportunity to surround Smith with a strong ensemble. The original "Wild Bunch" starred William Holden, Ernest Borgnine, Robert Ryan, Edmond O'Brien, Warren Oates, Jaime Sanchez and Ben Johnson.

Smith has never done a proper Western before, though he was sought to star in Quentin Tarantino's "Django Unchained" and Kathryn Bigelow's since-abandoned "Triple Frontier." WB's 1999 movie "Wild Wild West" was set in the Old West but the material was played for laughs.

Smith will soon be seen alongside his son Jaden Smith in M. Night Shyamalan's action-adventure movie "After Earth," which Sony opens May 31. He recently filmed a small but key role in Akiva Goldsman's directorial debut "Winter's Tale" and he's set to star in WB's con artist tale "Focus." After that, the only firm starring vehicle on his slate is Ed Zwick's Hurricane Katrina drama "The American Can."

Overbrook produced "After Earth" and it is also producing Sony's remake of the beloved musical "Annie," which will star Quvenzhane Wallis and Jamie Foxx.

Smith is represented by CAA.

(AP) ? Research In Motion unveiled a lower-cost BlackBerry aimed at consumers in emerging markets on Tuesday, stepping up its efforts to regain market share lost to Apple's iPhone and Android devices powered by Google's software.

The lower-cost gadget, called the Q5, is the company's third smartphone to run the new BlackBerry 10 system. It will have a physical keyboard, something that sets RIM's devices apart from Apple's iPhone and most Android phones.

RIM CEO Thorsten Heins said the "slim, sleek" device will be available in red, black, white and pink. He announced the phone to a packed ballroom to open RIM's annual three-day conference in Orlando, Florida.

The device will be available in Europe, the Middle East, Africa, Asia (including the Asia Pacific region), and Latin America beginning in July. The Q5 isn't expected to be released in North America for now. The company did not disclose prices for the new phone.

RIM's higher-tier Q10 has been released in most markets, but delays have meant that U.S. carriers aren't likely to have it until June. The U.S. delays complicate RIM's effort to hang on to customers tempted by Apple's iPhone and a range of Android smartphones. Even as the BlackBerry has fallen behind rivals in recent years, many users have remained loyal because they prefer a physical keyboard over the touch screen found on other devices.

The Q5 differs only slightly from the Q10. Both have 2GB of RAM, though the Q5 has only 8GB of flash memory compared to 16 for the Q10. Both have 2 megapixel front-facing cameras, but the Q5's rear-facing camera is only 5 megapixels, compared to the Q10 which has 8 megapixels and also records high-definition video.

Also, the Q5 has a 3.1-inch LCD display, while the Q10 is 3.1 inches and LED.

RIM unveiled new BlackBerrys this year after delays allowed Apple and others to continue their global advance.

RIM's iconic BlackBerry device, introduced in 1999, was the dominant smartphone for on-the-go business people and consumers for nearly a decade. But rivals came out with a new generation of phones that could do more than just email and messaging, starting with the iPhone in 2007 and followed by devices running Google's Android system. Suddenly, the BlackBerry looked ancient.

According to research firm IDC, shipments of BlackBerry phones plummeted from 46 percent of the U.S. market in 2008 to 2 percent in 2012.

Though RIM continues to do well in many overseas markets, the company faced numerous delays modernizing its operating system in an effort to compete with the iPhone and smartphones running Google's Android operating system.

Heins, who became RIM's CEO in January 2012, said the company has made a lot of progress in a short period of time.

He restated BlackBerry's committed to "mobile first" and took a subtle jab at industry predictions that he might not make it to this year's conference as CEO because of the competitive mobile landscape.

"I'm happy to say they were wrong," Heins said. "We are not only still here. We are firing on all cylinders as a company."

RIM's stock fell 63 cents, or 3.8 percent, to $15.25 in afternoon trading Tuesday.

RIM also said it will offer its once-popular BlackBerry Messenger service on iPhones and devices running Google's Android software.

Heins said iPhone and Android versions of the BlackBerry Messenger app will be available for free, subject to approval by Google Play and the Apple App Store.

"It's time to bring BBM to a greater audience," Heins said. "I cannot wait for the day when all of our BlackBerry fans can send BBM invites to all their friends on other platforms. They have asked us for this for years."

The BBM service was once a reason for BlackBerry users not to defect to other smartphones. Now, there are many rival messaging services. Still, there are more than 60 million BBM users worldwide.

BBM works like text messaging but doesn't incur extra fees.

Colin Gillis, an analyst at BGC Partners, said offering BBM on rival platforms is a good move because closed ecosystems don't work anymore. He said the company was forced to do it but said it might be too late.

"BBM is a communication network and it's only as powerful as people who are on it," Gillis said.

Heins said RIM is "definitely in the race" and that he is excited about the company's outlook, predicting the most successful year for BlackBerry.

"What I can say is that 12 months ago I was told we would be out of business in two quarters, and that we could burn through our cash within two quarters. It didn't happen. We are confident in the future of BlackBerry 10."

Asked about a move away from tablet technology, Heins said that the future is in mobile and that BlackBerry's new initiatives are to target a consumer it thinks will rely on one mobile device for all communications within seven years.

RIM's tablet, the Playbook, has not sold well.

"You will always have people that are in a very limited view (asking questions) like 'when are you going to take on Apple?'" Heins said. "That's not the way I'm thinking about this."
